This page explains how to ask us to delete personal information we hold about you. In this page, "we", "us", "our" and "Scalus" mean TMC Media Pty Ltd (ABN 26 660 757 415), trading as Scalus App, of Melbourne, Victoria, Australia. This page should be read together with our Privacy Policy, which forms part of how we handle personal information.
To request deletion of personal information we hold about you, email privacy@scalus.app with the subject line "Data Deletion Request" and include:
We may need to verify your identity before actioning a request, to protect your information and to make sure we are dealing with the right person. We will not action a deletion request from someone we cannot reasonably verify is you or your authorised representative.
We will acknowledge your request and aim to respond within a reasonable time, usually within 30 days. Where we are able to delete the information, we will delete it or de-identify it from the systems we control, and we will ask our service providers to do the same where applicable. We will let you know once this is done, or explain if we are unable to fully action your request and why.
Some information cannot be deleted on request, and you acknowledge that we may retain it. This includes information we are required or permitted to keep by law (for example, financial, tax, billing and business records), information we reasonably need to establish, exercise or defend a legal claim, to resolve a dispute, to prevent fraud or misuse, or to enforce our agreements, and information held in routine backups. Where we keep information for these reasons, we will hold it only for as long as reasonably necessary and continue to protect it in line with our Privacy Policy, and we will delete or de-identify it when it is no longer needed.
We provide marketing, website and automation services to business clients. In doing so, we often hold personal information about our clients' own customers, leads and contacts on the client's behalf and under the client's instructions. For that information, the client — not Scalus — generally decides what is collected and how long it is kept.
If you are a customer or lead of one of our clients and you want your information deleted, please contact that business directly, as they are best placed to manage it. You may also contact us at privacy@scalus.app and, where appropriate, we will pass your request to the relevant client or assist them in actioning it. We may be unable to delete client-held information ourselves without the client's instruction, except where the law requires us to act.
Deleting your information may mean we can no longer provide some or all of our services to you, respond to your enquiries, or maintain your account, and some actions may not be reversible. Deletion does not, by itself, terminate any services agreement or affect any fees already due — those are governed by our Terms & Conditions.
Nothing on this page limits any right you have under the Privacy Act 1988 (Cth) or the Australian Privacy Principles. If you are not satisfied with how we handle a deletion request or any privacy matter, you can complain in writing to privacy@scalus.app, and if you remain unsatisfied you can contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au or on 1300 363 992. The OAIC generally expects you to raise your complaint with us first and give us a reasonable chance to respond.
